Financial Information

Billing and other financial information (such as your credit card number or bank account number when combined with your billing address and referred to collectively as Financial Information) will be required to register for certain programs and other transactions, such as purchases of manuals or group shuttles where applicable. Soma Yoga Institute does not collect and store financial information. Purchases are made through 3rd parties currently these are Kajabi, Wise, PayPal and Stripe.

Soma Yoga Institute does not enter or store any Financial Information in its computers, networks, facilities, online database, or files, although tokens do reside on our systems until all transactions with you have been finalized. Unless otherwise noted at the payment entry point, financial information is processed and ultimately stored on a platform currently operated and controlled by Stripe https://stripe.com/, Kajabi https://kajabi.com/, and/or PayPal https://www.paypal.com/us/home, these are PCI-compliant services that handle all of our payment processing. We do not review your Financial Information if you engage in a payment transaction, although we do know the amount that is charged to your credit card or debited from your bank account in any such transaction. We may also receive your billing address. Payment processing is governed by the Stripe terms/PayPal Terms/Kajabi Terms and privacy policies, available at https://stripe.com/, https://www.paypal.com/us/home https://kajabi.com/, or via terms otherwise noted at the payment entry point. Please note that we may change our Financial Information processor at any time, in which case, this Policy will be updated.

Names and Emails

Emails are never sold to outside parties.

Names and emails are collected through opt in forms on our website and stored in the third party, Flodesk (https://flodesk.com/) and/or kajabi (https://kajabi.com/). Names and emails are also stored in third party website, Calendly https://calendly.com/ when students book a zoom or phone call appointment with us. Names and emails of students enrolled in our programs and courses are stored in 3rd party Google Sheets (https://policies.google.com/). We collect this information to keep in touch about our upcoming programs and events. We use email and name data to send newsletters, program updates and program specific information. Students may opt out anytime using the opt out button on the bottom of the email or by emailing info@somayogainstitute.com. Soma Yoga Institute partners with Trustpilot https://www.trustpilot.com/ to collect reviews on their programs.  Emails of graduates are shared with Trustpilot for the sole purpose of soliciting a program review.  Other than this instance emails are never shared with outside parties.

Additional Collected Personal Information

When students register for an online course or program we collect name, email, address, phone number. This contact information is used to contact the student with course/program relevant information. This information is collected through online forms on our website and stored in 3rd party website Kajabi (https://kajabi.com/).

When students register for our in-person program the following information is collected: Name, email, address, phone/whats ap number, gender identity, and pronouns. This contact information is used to contact the student with course/program relevant information. We collect gender relevant data so that we may assign roommates accordingly. This data is stored in a 3rd party website called Kajabi (https://kajabi.com/).

For all registered student’s, information collected on your waiver form which includes name, address, phone, birthdate, emergency contact, health conditions are stored in a 3rd party website, Dropbox Hellosign sign (https://www.dropbox.com/hellosign).


Right to Personal Data

Users have the right to obtain confirmation from the organization as to whether their personal data is being processed and, if so, access to that data. Users have the right to request the correction or rectification of inaccurate or incomplete personal data. Users have the right to request the deletion of their personal data under certain circumstances, such as when the data is no longer necessary for the purposes it was collected or when the user withdraws their consent. Users have the right to request the restriction of processing their personal data in specific situations, for example, when the accuracy of the data is contested, or the processing is unlawful. Users have the right to receive their personal data in a structured, commonly used, and machine-readable format and have the right to transmit that data to another controller. Users have the right to object to the processing of their personal data, including profiling, based on legitimate interests or direct marketing purposes. If the processing of personal data is based on user consent, users have the right to withdraw their consent at any time. Users have the right to lodge a complaint with a supervisory authority if they believe their data protection rights have been violated. Additional information may be requested as part of an application for a scholarship or other financial assistance. Required details generally include your income level, demographic information, and other information necessary for Soma Yoga Institute to process your request for financial assistance.

Applicants are invited to provide additional information relevant to their applications. Soma Yoga Institute received these scholarship applications via email at yoga@somayogainstitute.com and purged periodically.

You may submit testimonials to us directly or via Program evaluations and are also invited to tag Soma Yoga Institute in social media postings. Information submitted or shared in this manner is subject to the terms of this Policy.

Information Collected Automatically

Meta Data
Certain information may be gathered automatically through a variety of mechanisms, including non-identifying information, an IP address, referring URL, browser, operating system, cookie information, and Internet Service Provider (Meta Data). Generally, this kind of information on its own cannot be used to identify you.

Soma Yoga Institute does not use automatic means to collect Personal Data, but we may associate Meta Data with Personal Data you or someone authorized by you has provided to us.
Whenever we associate Meta Data with your Personal Data, it will be treated as Personal Data.

Internet-Based Third-Party Advertising and Do Not Track Technology

Other than as provided for in this Policy, we generally use your Information for the purpose for which it was submitted. For example:
• If you provide Your Information to register for a Program or course with Soma Yoga Institute, we will use Your Information to process the registration.
• If you apply for a scholarship or other financial assistance, we will use it to evaluate and process your application. In addition, if you’ve provided permission, we may include your story in Soma Yoga Institute-generated media and publications; or
• If you request materials and Services, we will use Your Information to respond to and process your request and may also add you to our database in order to provide you with additional materials and information in the future.

We also share or transfer Your Information as directed or authorized to do so by you or where you consent to such disclosure. We may aggregate Your Information with the information of other individuals in order to analyze and compare information as between users of our Sites and Services.

Programs & Our Collaborators
When you attend an onsite live or online training Program, we may use and share Your Information as follows: typically, we will only disclose or share aggregate, anonymous, or de-identified information for research, compliance, marketing, advertising, or other purposes. We may, however, publicize direct quotes or testimonials from responses to a survey or evaluation; provided, however, that we will not disclose the participant’s name associated with the quote without that participant’s express, prior permission.


Soma Yoga Institute Promotional and Marketing Activities; Recordings
At times, we may take photographs and/or make audio and video recordings of participants in our live courses to promote the benefits of participating in our Programs and Services. If you are a participant of a Soma Yoga Institute in-person program, you will be required to sign a Waiver and Release upon arrival (a sample of which is available upon request), which addresses permissions and other rules related to use of photographs and other recordings made by Soma Yoga Institute. In addition, Soma Yoga Institute may use testimonial statements provided to us via an evaluation form or otherwise, as well as statements, photos, quotations, and other information you share via a Soma Yoga Institute social media account (including where you have tagged Soma Yoga Institute in your own social media posts), for general marketing and promotional purposes. This use may include reference to your social media name/account.

Release of Your Information for Legal Purposes
We may access, use, preserve, transfer, and disclose Your Information (including Personal Data), including disclosure to third parties, to the fullest extent permitted by applicable law: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Sites or other policies applicable to the Sites or Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Services or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues. As a general matter, the Sites are not intended for use by children. We do not knowingly collect any Personal Data from children younger than the age of sixteen (16) through our Sites. We, and our servers, are located in the United States and are subject to the applicable U.S. local and national laws. THESE TERMS APPLY ONLY TO THE SERVICES IDENTIFIED BELOW (THE “SERVICE” OR “PROGRAM”). SOMA YOGA INSTITUTE MAY MAKE AVAILABLE OTHER SERVICES (“THIRD-PARTY SERVICES”) ADMINISTERED BY A THIRD-PARTY (“THIRD-PARTY SERVICE PROVIDER”). YOUR USE AND ACCESS OF THIRD-PARTY SERVICES ARE GOVERNED BY THE THIRD-PARTY SERVICE PROVIDER’S PRIVACY POLICY AND TERMS OF SERVICE.

These Terms, constitute the Agreement for your use of Service being purchased, which is made available by Soma Yoga Institute. The Agreement is subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms will be in effect as of the “Last Updated Date” and accessible via the website. You are responsible for reviewing those terms periodically. Your continued use of the Service will constitute your acceptance of and agreement to all such changes.

ORDER ACCEPTANCE/CONFIRMATION. You agree that your order is an offer to buy under the Agreement. Soma Yoga Institute reserves the right to accept or reject orders in its sole discretion.

PRICING/PAYMENT
US Dollars. All prices are in US dollars except where noted clearly.

Prices Subject to Change. All posted or advertised prices posted are subject to change without notice. The price charged for the Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your order total (as applicable) and will be itemized in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer made by us and we reserve the right to cancel any orders arising from such errors.

Payment Terms; Method. Terms of payment are within our sole discretion and are currently processed via Stripe and/or PayPal. Full payment is due at time of registration and can be made with a credit card, debit card or PayPal. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

All registrations and bookings are subject to Soma Yoga Institute’s cancellation policies listed below. PLEASE REVIEW THE SPECIFIC CANCELLATION AND REFUND POLICIES FOR EACH SERVICE:
SOMA YOGA INSTITUTE RESERVES THE RIGHT TO CANCEL ANY SERVICE OR PROGRAM AT ANY TIME. IN THIS EVENT, YOU WILL BE GIVEN A COMPLETE REFUND OR CREDIT (AT OUR DISCRETION). A REFUND WILL BE CREDITED BACK TO THE ORIGINAL PAYMENT METHOD OR CARD; AND A CREDIT WILL BE APPLIED TO YOUR SOMAYOGAINSTITUTE ACCOUNT AND WILL REMAIN VALID FOR A PERIOD OF 12 MONTHS.

Happiness Guarantee and Refund Policy applies to the 200 Hour Online Therapeutic Yoga Teacher Training Course, Therapeutic Kids Yoga Teacher Training Course and 300 Hour Online Yoga Teacher Training Course.

The Happiness Guarantee is as follows: We are so certain that you will love this training that we are offering you a two-week risk-free guarantee. If you are not satisfied with the material after the first two weeks of the course, we will refund 100% of your money - just email us by 14 days after the start of the program and complete an exit interview so we can learn how to improve our educational programs for the future. After this 14 day from your official program start date window, there will be no refunds issued.

Deposit and Tuition Payment Terms for all of our In-Person Yoga Teacher Trainings
A $500 USD deposit will reserve your space and will be applied to the full tuition price listed above. Deposits, tuition, and housing payments minus a 10% processing fee, are refundable up to 31 days prior to retreat start date. The 10% processing fee will apply to all refunds and this fee covers credit card charges and administrative processing fees.

Retreat costs (housing and food) are due three months prior to the start date of the program or within two weeks of registering and your final tuition payment is due no later than one month prior to the program start date. If you would like to discuss alternate arrangements or a payment plan, please feel free to contact us directly and we would be happy to work something out.

Fee-free transfers for documented health/emergency situations: If cancellation is necessary prior to the first day of the program due to documented health or emergency situations, a student’s deposit and tuition will be fully transferable to a future program with Soma Yoga Institute. In all other circumstances, due to the logistics involved in planning residential programs in retreat settings, we regret that we are unable to issue deposit/tuition/housing refunds 30 days or less prior to program start date. No refunds are issued on or after the program start date for any reason.


ONLINE Technical Issues. Users are entirely responsible for having working internet, computers and other technology necessary to connect to the Soma Yoga Institute offering at the date and time the Program is offered. However, if technical issues caused by Soma Yoga Institute or its third-party providers result in cancellation or outages/content loss, then Soma Yoga Institute in its sole and exclusive determination may offer the following in place of a refund or credit:
Soma Yoga Institute will make up the Program sessions and/or provide a recording to those who were prevented from attending;

In cases where the Program is interrupted, and the lost content/presentation is material to the Program, Soma Yoga Institute will facilitate the delivery of the missing content/materials as determined by Soma Yoga Institute in collaboration with the presenter, within a reasonable period of time following the original Program delivery date(s).

COVID PROTOCOLS: You agree to follow all current COVID Protocols put in place by Soma Yoga Institute to protect the safety of the community and acknowledge that if you do not follow the protocols, you may be asked to end your stay and the forfeiture of any amounts paid. These protocols are subject to change and you are responsible for reviewing them before and remaining current on any changes during your stay.

RECORDINGS. Soma Yoga Institute reserves the right to record in any manner or medium, certain programs and sessions, and by participating in our programs, you agree that your voice, image and likeness may be recorded (audio, video, etc.). The recordings shall constitute Soma Yoga Institute intellectual property, and may be used, sold, licensed, broadcast, and otherwise commercially exploited as determined by Soma Yoga Institute in its sole and reasonable discretion. You hereby grant to Soma Yoga Institute and its affiliates and assigns the right and permission to use in perpetuity, your name, likeness, image, voice, recorded voice, appearance, biographical information, statements, performance and/or testimonial(s) (Appearance) in any manner and in any media, now known or later developed, throughout the world, at any time, for Soma Yoga Institute business purposes, without review, permission or compensation of any amount or kind whatsoever. In addition, our third-party providers—such as Zoom—may also record programs for their or our archival purposes. You shall not hold Soma Yoga Institute responsible for any liability resulting from the lawful use of your Appearance in accordance with the terms of this section, or the recording activities described hereunder.

FORCE MAJEURE: Neither Soma Yoga Institute nor any of its third-party providers shall be liable for any failure or delay in the performance of its obligations under the Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation, acts of God; natural disasters; wars; civil or military disturbances; sabotage; strikes; epidemics or pandemics; riots; power failures; computer failure; loss or malfunction of utility, transportation, computer (hardware or software) or telephone communication service; accidents; labor disputes, acts of civil or military authority; governmental actions; or inability to obtain labor, material, equipment or transportation. The foregoing notwithstanding, technical issues experienced or caused by Soma Yoga Institute and/or its third-party providers are addressed in Section 2 above.

LIMITATION OF LIABILITY: To the greatest extent permitted by law, in no event shall Soma Yoga Institute or its employees, agents, partners, suppliers or content providers be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the program (i) for any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising), (ii) for any bugs, viruses, Trojan horses or the like (regardless of the source of origination) or (iii) for any direct damages in excess (in the aggregate) of the greater of (a) fees paid to us for the particular program or (b) $100.00. These limitations will only apply to the extent permitted by law and do not apply to death or personal injury resulting from our acts or omissions or to liability resulting from our gross negligence or willful misconduct.
